Welcome to Cusco Private Transfer. These Terms and Conditions govern the booking and use of our private transportation and private tour services. By booking a service with us, you confirm that you have read, understood, and agree to these terms.

1. About Our Services
Cusco Private Transfer provides private, exclusive ground transportation and private tour services in and around Cusco, Peru, including but not limited to:
- Private transfers between Cusco Airport, hotels, and train stations (Ollantaytambo, Poroy)
- Private transfers to and from the Sacred Valley
- Private full-day and half-day tours (Cusco City Tour, Sacred Valley, Rainbow Mountain, Humantay Lagoon, Maras and Moray, South Valley)
All services described on this website are private and exclusive to the group that books them, unless otherwise stated.
2. Bookings and Confirmation
- Bookings can be made through our website, WhatsApp, or email, providing the requested details: service, date, pick-up location, number of passengers, and any special requirements.
- A booking is considered confirmed only after we send written confirmation (via WhatsApp or email) and, where applicable, receipt of the required deposit or payment.
- It is the customer’s responsibility to provide accurate flight numbers, train tickets, hotel names, and contact information. We are not responsible for delays or missed pick-ups resulting from incorrect information provided at the time of booking.
3. Rates and Payment
- Rates are quoted per vehicle, not per passenger, and depend on the vehicle type, route, and group size.
- Prices are confirmed at the time of booking and may vary for last-minute reservations, holidays, or high-season dates.
- Accepted payment methods will be communicated at the time of booking. A deposit may be required to confirm certain services.
- Any additional stops, extra services (meals, horse rental, entrance tickets, tour guide), or itinerary changes requested during the service that go beyond the original booking may incur additional charges, to be agreed upon with the driver or our coordination team.
4. Cancellations and Changes
- Cancellation requests must be made in writing (WhatsApp or email).
- Refund conditions depend on how far in advance the cancellation is made:
- 20 days before the service: full refund minus any non-refundable deposit or transaction fees.
- 10 days before the service: partial refund of 30%.
- Less than 12 hours before the service, or no-show: no refund.
- We reserve the right to modify, delay, or cancel a service due to circumstances beyond our control (see Section 7 — Force Majeure), in which case we will offer an alternative date or a full refund.
- Changes to pick-up time, date, or itinerary should be requested as early as possible and are subject to availability.
5. Passenger Responsibilities
- Passengers must be ready at the agreed pick-up location and time. For airport and train station pick-ups, drivers will wait a reasonable grace period; extended delays caused by the passenger may result in additional waiting charges or a missed pick-up.
- Passengers are responsible for carrying valid identification, travel documents, and any required entrance tickets for the sites visited (entrance fees are not included unless explicitly stated).
- Passengers are expected to treat vehicles, drivers, and other passengers with respect. We reserve the right to refuse or discontinue service in cases of abusive behavior, property damage, or actions that compromise safety.
- For tours involving hiking at high altitude (e.g., Rainbow Mountain, Humantay Lagoon), passengers are responsible for assessing their own physical condition and acclimatization before participating, and should consult a doctor if they have relevant health concerns.
6. Luggage and Personal Belongings
- Each vehicle has a specified luggage capacity, listed for each service. Passengers should inform us in advance if they are traveling with oversized or additional luggage.
- Cusco Private Transfer is not responsible for personal items left in the vehicle, lost, or damaged, except where loss or damage results directly from our negligence.
7. Force Majeure
We are not liable for delays, cancellations, or changes to a service caused by circumstances beyond our reasonable control, including but not limited to: road closures, strikes (“paros”), civil unrest, extreme weather, natural disasters, landslides, government restrictions, or train/flight cancellations by third-party operators. In such cases, we will make reasonable efforts to offer an alternative solution.
8. Limitation of Liability
- Cusco Private Transfer maintains passenger insurance in accordance with Peruvian transportation regulations.
- Our liability is limited to the direct cost of the service booked. We are not liable for indirect losses, including missed onward connections (trains, flights, tours booked with third parties) resulting from circumstances outside our control, including those described in Section 7.
- We are not responsible for the actions, cancellations, or service quality of third-party providers (hotels, restaurants, train operators, ticketing offices) recommended or coordinated on the customer’s behalf.
9. Photography and Media
We may take photographs or videos during tours for promotional purposes. If you prefer not to appear in such material, please let your driver or our team know in advance.
10. Privacy
Personal information provided during booking (name, contact details, flight/train information) is used solely to coordinate and provide the requested service, and is not shared with third parties except as necessary to deliver the service (e.g., confirming details with a hotel).
11. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Peru. Any dispute arising from these terms will be subject to the jurisdiction of the courts of Cusco, Peru.
